In this essay, Prof. Avv. Alessandro del Ninno carries out a reasoned analysis of articles 9 and 10 of the so-called Capacity Decree with which the Italian Government enacted amendments to the Italian Data Protection Code, with particular reference to the processing of common personal data carried out by public and private entities for the performance of a public task or in the exercise of public authority, pursuant to articles 2-ter of the Italian Data Protection Codee and 6, paragraph 3, letter (b) of the GDPR.
