Legislative decrees 177/2021 and 181/2021 implementing EU Directives 789/2019 and 790/2019: the new rules of the Copyright Law for the digital single market and the online broadcasting and retransmission of radio content and televisions.

On December 12th and 14th the most important changes made to the Italian Copyright Law for several years now came into force. The Legislative Decree 8 November 2021, n. 177 - which implemented Directive (EU) 2019/790 - entered into force on 12 December 2021 and introduced advanced and technologically updated rules for the lawful use of works and editorial content in the digital market (the new legislation introduces the much expected recognition of adequate remuneration of related rights in favor of publishers of on line journalistic publications).
New rules on the obligations of service providers who offer sharing service of protected content online (es: You Tube) also came into force, as well as other important amendments and new rules to the other parts of the Italian Copyright Law.

The Legislative Decree 8 November 2021, n. 181 - which transposed Directive (EU) 2019/789 - entered into force on 14 December 2021 and introduced the new discipline of copyright and related rights relating to the online transmission and retransmission of radio and television content. In particular, the new rules incorporate the European provisions relating to ancillary online services, the application of the country of origin principle to the latter, the exercise of retransmission rights and the transmission of programs by direct entry.
