Processing of personal data relating to criminal convictions and offences in the public sector.

Starting from the analysis of article 10 of the GDPR, the lesson is focused on the relationship between the GDPR and the Consolidated Act no. 313/2002 (as amended by the legislative decree as of October 2, 2018 no. 122) introducing rules on criminal records' access and management.
The practical analysis also includes the Italian Data Protection Code's specific rules on the processing of such data (art. 2-octies) and the Italian Data Protection Authority's official position on the need for the Italian Public Administrations to update the internal regulations on the processing of sensitive and judicial data, as formerly provided before the entering into force of the GDPR.
