In this interview, Prof. Avv. Alessandro del Ninno carries out a reasoned analysis of the political and legal context which has led the Italian Government to enact - with articles 9 and 10 of the so-called Capacity Decree - amendments to the Italian Data Protection Code, with particular reference to the processing of common personal data carried out by public and private entities for the performance of a public task or in the exercise of public authority, pursuant to articles 2-ter of the Italian Data Protection Codee and 6, paragraph 3, letter (b) of the GDPR.
