Law rules on the electronic platform for collecting digital signatures for referendums published in the Italian Official Gazette.

Presidential Decree No. 277/2022 was published in Official Gazette No. 277/2022 on "Regulation of the platform for the collection of voter signatures required for referendums under Articles 75 and 138 of the Constitution."

This decree consists of 10 articles and regulates the mode of operation of the platform, defining:
  • the technical characteristics, security requirements, cases of malfunction, and the manner in which the platform operator certifies the malfunction and communicates the restoration of functionality (Article 3);
  • the general architecture and mode of operation (Art. 4);
  • the manner in which the initiators of signature collection make the electronically collected signatures available to the Court of Cassation (Art. 5);
  • the methods of access (art. 6);
  • the types of data subject to processing, the categories of data subjects and, in general, the methods and procedures for ensuring compliance with the GDPR (Art. 8).
The platform, accessible through the portal, is organized into a "public area" and a "private area." While the latter is accessible only with a digital identity based on credentials of at least significant level ("Court of Cassation" user, "Promoter Subjects" user and "Citizen" user) the "public area" allows the consultation of referendum proposals and related questions as well as popular law proposals, pending and expired, with an indication of the number of signatures collected up to the time of viewing. It also allows consultation of all the information necessary to participate in the collection of signatures through the same platform.
