Civil servants are held liable for the content of e-mails under the new Code of Conduct for public employees.
Civil servants are held liable for the content of e-mails. This is what is stipulated in Article 1 of Presidential Decree 81/2023 (in force from 14 July 2023, published in the Official Gazette of 29 June 2023), which amended the Code of Conduct for public employees, laying down new rules regarding the use of electronic devices and services.
Presidential Decree 81/2023 adds to the previous Presidential Decree, 62/2013, Article 11-bis, under the heading 'use of information technology', dealing with the electronic mail service.
In particular, the third paragraph of the aforementioned article makes the civil servant responsible for the content of messages sent by e-mail service. The provision goes on to require civil servants to comply with the methods for signing service e-mail messages identified by the administration to which they belong. Finally, it specifies that each outgoing message must allow for the identification of the sending employee and must indicate an institutional address at which he or she can be reached.
