EU Commission: Pornhub, Stripchat and XVideos designated as VLOPs under the DSA.
The EU Commission has implemented Article 33 of the Digital Services Act (Regulation 2022/2065), supplementing the list of VLOPs (Very Large Online Platforms) previously designated in April 2023 (together with VLOSEs, the large search engines, a total of 19 platforms and engines) and which are subject to the more stringent obligations under the DSA. The Commission has supplemented the list by adding three adult service portals to the list of VLOPs:
Pornhub
Stripchat
XVideos.
These platforms will therefore also have to - among other things - put in place mitigation measures to address risks related to the dissemination of illegal content online, design their services, including interfaces, recommender systems and terms and conditions, to address and prevent risks to the well-being of minors, strengthen their internal processes, resources, testing documentation and oversight of all their activities related to the identification of systemic risks, carry out risk assessments, provide access to publicly available data to researchers, including vetted researchers designated by national digital service coordinators, ensure transparency, appoint a compliance function, and cooperate in conducting an independent external audit every year.
