EU Commission: the validity of the decision on the adequacy of the UK legal system under the GDPR has been extended to 27 December 2025.
The European Commission has published the draft technical extension of the current decision on the adequacy of the UK legal order (referred to in Implementing Decision 2021/1773, which - pursuant to Chapter V of the General Data Protection Regulation - GDPR - declared a substantial equivalence in data protection of the UK legal system with respect to the protection guaranteed by the GDPR, and applies for a period of four years, expiring on 27 June 2025.
This extension is intended to allow the EU Commission to assess the impact of the changes to the UK GDPR and the UK Data Protection Act 2018 proposed in the Data (Use and Access) Bill currently being discussed in the UK.
As a result, the draft technical extension allows an additional six months for the Commission to assess whether the UK continues to provide an adequate level of protection for personal data.
