EU Commission: DMA and Artificial Intelligence, public consultation launched for the review of the regulation on digital markets.

The European Commission has launched a broad public consultation process aimed at gathering views and comments on the effectiveness of the Digital Markets Act (DMA) in promoting fair, open and contestable digital markets, with a particular focus also on the emerging challenges arising from the use and deployment of artificial intelligence (AI)-based services.

The initiative is part of the periodic review of the legislation envisaged by the European legislator. With the call for evidence, the Commission provided further clarifications on the review process and issued a specific questionnaire on AI, aimed at assessing the extent to which the DMA can be a suitable tool also with respect to technological evolution and the growing importance of digital platforms integrating artificial intelligence models into their services.

The exam has as its main objectives:

  • verify whether the measures introduced by the DMA have guaranteed truly contestable market conditions, also to the benefit of SMEs and innovative start-ups, traditionally more exposed to competitive imbalances;

  • measure the impact of the rules on consumers, in terms of transparency, choice and protection against exclusionary practices;

  • identify possible areas for regulatory improvement, also in light of the rapid adoption of generative and predictive AI systems in digital platforms;

  • understand how gatekeepers are adapting to the obligations of interoperability, transparency and limitation of self-preferential practices in a context where AI-based services are taking on an increasingly strategic role.

The input collected by 24 September 2025 will feed into the Commission's report on the review of the DMA, which is scheduled to be submitted to the European Parliament, the Council and the European Economic and Social Committee in May 2026.

For companies in the digital sector – and in particular for operators developing or integrating AI solutions – this is a significant opportunity to influence the future evolution of the European regulatory framework, in a context in which the coordinated application of DMA and AI Act will become decisive for the governance of technology markets.
