The EU's Digital Services Act worries big companies.

DIMA (European Digital Media Association), a lobby group that takes care of the interests of large web and high tech giants such as Apple, Google, ByteDance (TikTok), Microsoft, Facebook and Amazon, would have sent an official appeal to the European Union in which greater protection would be required in cases where platforms have to remove content in violation of current regulations.

The subject matter of the application is now sufficiently well known, in Europe services such as social networks and search engines are obliged to promptly delete any sharing (even a simple link) that represents an offence, but this moderation activity would enjoy little legal protection with negative repercussions for freedom of expression and the quality of contributions.

EDIMA would be moving towards a possible Digital Services Act (DSA), the draft of which would currently be the subject of analysis by the European Commission, which could make the rules on what may or may not be published on the Net even stricter and what content could lead to onerous sanctions in case of non-moderation.

A difference from the regulatory system available today could be the reporting mechanisms, according to the rules in force in fact platforms can be held responsible for the illegality of sharing only when they become aware of it. Deleting content after a report may be enough to avoid any consequences. It is true, however, that large services also use automated systems to do this. Is having an AI algorithm that can detect violations enough for these to be considered as "known" to managers? If the EU opts for this hypothesis, the Big Names on the Web may also find themselves "helpless" in the event of a dispute by the authorities.
