Regulating the use of Artificial Intelligence tools by employees.

The conference “Regulating the Use of Artificial Intelligence Tools by Workers”, organised by Paradigma on 26 November 2025, provides a comprehensive and multidisciplinary overview of the relationship between AI and the workplace, addressing both organisational implications and the legal, trade-union and compliance impacts. The event brings together experts in the legal and technological fields to analyse the introduction of Artificial Intelligence tools into corporate processes, with a specific focus on HR management, corporate policies and employer monitoring activities.

The contribution of Avv. Alessandro del Ninno clarifies the regulatory landscape governing the use of AI by employees, illustrating the interaction between:


traditional labour legislation based on mandatory rules,
– the EU Artificial Intelligence Act,
– the Directive on digital labour platforms,
– the General Data Protection Regulation (EU) 2016/679 (GDPR) and the Italian Privacy Code,
– the opinions and decisions of the Italian Data Protection Authority (Garante Privacy),
– and the new Italian Artificial Intelligence Act (Law No. 132/2025).

 

Particular emphasis is placed on the Guidelines issued by the Ministry of Labour on the implementation of AI in the workplace, which set out operational practices, technical criteria and employer responsibilities when introducing algorithmic systems. Avv. Del Ninno also examines the issues relating to data protection, data security and risk assessment, focusing on aspects such as data minimisation, algorithmic transparency, lawful bases for processing and the limits applicable to indirect monitoring of employees.
